To assure compliance with provisions of the Zoning Ordinance and to protect the character of residential neighborhoods in the Town of Rockville, a Conditional Use Permit for a Bed & Breakfast Establishment shall be obtained from the Town.
Additionally, to minimize the impact of bed and breakfasts, there may be no more than five (5) such establishments in the Town of Rockville. The existing five (5) bed and breakfasts are considered preexisting, nonconforming uses.
Applications for a Conditional Use Permit for a Bed & Breakfast Establishment shall be submitted to the Rockville Town Planning Commission. Applications will be reviewed by the Town Planning Commission. Upon approval of an application a Conditional Use Permit for a Bed & Breakfast Establishment will be issued, which permit shall state the conditions attached thereto, and any time limitations imposed thereon. The permit shall not be issued unless the applicant has met all of the conditions listed below, and the applicant has agreed in writing to comply with all said conditions and any other conditions which the Planning Commission has recommended and which the Town Council has approved.
6.2.1 Conditions Placed on all Bed and Breakfast Establishments
A “Bed & Breakfast” establishment may be permitted in any residential zone provided it meets the following criteria:
A. The establishment may be housed in an existing or new structure suitable to the purpose of a Bed and Breakfast Inn. The structure must comply with the Uniform Building Code and all other applicable State and Town statutes, ordinances, and regulations.
B. The establishment must not have more than four (4) guestrooms for rent.
C. The Owner and/or Manager must reside in the Bed & Breakfast.
D. Off-street parking must be provided as noted: two (2) spaces for the owner and/or manager, and one (1) space per guestroom.
E. All signs are subject to the provisions of Chapter 7 of this Ordinance.
F. The establishment must be on a street that meets Town standards and Fire Code width requirements.
G. Entrances to all guestrooms must be on the interior of the structure. Secondary, exterior entrances to guestrooms shall be permitted only for access to patios, verandas, or balconies.
H. The architectural style and physical size of the structure shall be in harmony with the residential character of the Town of Rockville. The structure must not exceed the height restrictions which apply in the zone in which it is located.
I. The site must be planned and landscaped so as to minimize the impact on neighboring properties and in order to retain the residential character of the neighborhood.
6.2.2 Additional Uses Allowable
The Planning Commission and Town Council may allow the following uses so long as they are a part of and incidental to the Bed & Breakfast establishment:
A. Souvenir sales which are limited to registered guests with no on-site signage.
All Bed & Breakfast applications require written notification of the application and the date, time, and place of the meeting where such application will be considered to all property owners within 300’ of the location of the proposed Bed & Breakfast. Notification will be done by the Town. If the proposed location includes rental property, the owner’s written permission is also required.
An application fee of one hundred dollars ($100.00) shall accompany the initial application for a Conditional Use Permit for a Bed & Breakfast.
Any Conditional Use Permit for a Bed & Breakfast shall be reviewed and may be reviewed by the Planning Commission and may be revoked by the Rockville Town Council upon violation of any requirements of this Chapter, or upon failure to comply with any of the conditions or limitations of the permit, unless such violation is corrected within thirty (30) days of receipt of written notice thereof. A permit shall be revoked for repeated violations of the requirements of this Chapter, notwithstanding compliance to the violation notice.
In the event of denial of any permit, or of the revocation thereof or of objection to the limitations placed thereon, appeal may be made to the District Court.
A Conditional Use Permit for a Bed & Breakfast is not a business license, and the granting of said permit shall not relieve the permittee of any other license requirement of Rockville Town or of any other public agency.
If required by the State of Utah, a Utah State sales tax license will be required with Rockville
Town listed as a business location.
