InfoWest Wireless Service Contract

This is the contract one agrees to when one signs up for InfoWest Wireless service.

By signing up for any InfoWest Wireless service, you agree to the following terms.

  • The antenna(s), and related equipment wire, transceiver, (EQUIPMENT) are, and will remain, property of InfoWest.
  • Defective modems not purchased through InfoWest, are covered and warranted through original retailer or the Modem manufacturer. Modems purchased through InfoWest will be replaced an warranted by InfoWest according to the Manufacturer's terms of warrantee. Defective modems not under warrantee will be the responsibility of the SUBSCRIBER to replace.
  • InfoWest requires a 1 or 2 year service contract. In signing this agreement SUBSCRIBER agrees to a contract service term of 12 or 24 consecutive months.
  • If service is discontinued, the SUBSCRIBER agrees to return the EQUIPMENT to InfoWest's office during normal business hours, or to permit an InfoWest representative to enter SUBSCRIBER's premises to retrieve EQUIPMENT. If the EQUIPMENT is located in premises rented by SUBSCRIBER, to which to owner or manager has access, SUBSCRIBER hereby authorizes the owner or manager to allow entry of the InfoWest representative in SUBSCRIBER's absence. InfoWest shall not be liable for nail holes, cable entry holes, etc. which are made at the time of installation and which may remain after removal of equipment.
  • If, upon discontinuance of service, the SUBSCRIBER, does not promptly return the EQUIPMENT to InfoWest in working condition, the SUBSCRIBER agrees to apy InfoWest $400.00 for the EQUIPMENT, removal costs and additional other monies which SUBSCRIBER may owe InfoWest.
  • Early discontinuance of service will result in an early discontinuance fee of $250. Only in cases wherein the proper level of service may not be maintained will the early discontinuance fee be waived.
  • There will be a $99 fee charged when / if service is moved from the installed location
  • SUBSCRIBER understands and acknowledges that as long as the EQUIPMENT remains in their possession, there is the capability to receive certain signals providing certain types of services. Therefore, SUBSCRIBER agrees to pay monthly bill to InfoWest for such services until the EQUIPMENT may be repaired or replaced.
  • Loss or theft of the EQUIPMENT or physical damage to the EQUIPMENT is the responsibility of the SUBSCRIBER. SUBSCRIBER agrees to pay InfoWest the value of the EQUIPMENT or the cost to repair. Therefore, SUBSCRIBER agrees to provide reasonable access to their premises so that the EQUIPMENT may be repaired or replaced.
  • SUBSCRIBER acknowledges that costs of repair or replacement are subject to change and other charges related to possession and use of the EQUIPMENT may be increased at any time in accordance with applicable laws and regulations. Upon notice, SUBSCRIBER agrees to pay such charges or return the EQUIPMENT in good working order.
  • InfoWest reserves the right ot replace or upgrade the EQUIPMENT as needs arise. SUBSCRIBER acknowledges that InfoWest must be granted access, at all reasonable times, to the EQUIPMENT. InfoWest's intent is to keep the EQUIPMENT in the best possible condition, enabling it to provide the best possible service.
  • SERVICE LEVEL is the maximum data rate provided. Peak data rate will be affected by total system loading.
  • SUBSCRIBER is aware the theft of service and/or property, or willful injury, destruction or alteration of the EQUIPMENT may subject SUBSCRIBER to civil and/or criminal liabilities.
  • This agreement and the EQUIPMENT are not assignable or transferable by SUBSCRIBER and may be used only at SUBSCRIBER's address, unless otherwise authorized in writing by InfoWest.
  • In the event that it becomes necessary for InfoWest to commence legal proceedings to recover the EQUIPMENT, or collect payment thereof, SUBSCRIBER agrees to pay, as part of the judgment, InfoWest's costs of recovery and collection, including reasonable attorney's fees and court costs. I/We agree to pay all attorney's fees, court costs, filing fees, including charges or commissions that may be assessed to us by any collection agency retained to pursue this matter. I/We further agree to pay interest at the rate of 1.5% per month (18% per year.)
